Judgment reserved as Zuma’s team abandons state Capture report

The North Gauteng High Court has reserved judgment in President Jacob Zuma’s application to review and set aside former Public Protector Thuli Madonsela’s state of Capture report. This after the President’s legal team made a u-turn, abandoning half of his State Capture review application.

The President had initially argued that the State Capture report had no factual findings and should be sent back to the Public Protectors office for a re-investigation.

Zuma has been described as a central figure in state capture by lawyers representing opposition parties. They’ve told the North Gauteng High Court in Pretoria that a commission of inquiry appointed by Zuma himself would lack credibility.

President Zuma has taken the State of Capture report on review over its remedial actions calling for the Chief Justice to appoint a judge that will head up a State Capture Commission.

It was a tough day in court for Zuma’s legal team. It was a total of eight respondents teamed-up against Zuma. They argued that the public protector can legally order the president to set up a commission of inquiry headed by a judge who’s only selected by the Chief Justice.

Adv. Dali Mpofu, representing UDM and COPE says, “No sane president would object to the involvement of the Chief Justice to appoint a judge to head a commission.”

Adv. Steven Budlender, DA lawyer says, “There is nothing unusual with the Public Protectors remedial actions, only thing unusual is the presidents involvement.”

Zuma’s legal team stuck to its guns, saying the President cannot be dictated to by Madonsela. Zuma’s lawyer, Adv. Ishmael Semenya elaborates:

“To the respondents all of them, locate a source of law that says the Public Protector can go beyond her powers and encroach the principles of separation of powers.”
